Conditions of Use

§ 1 Item of the general terms of business
Item of the general terms of business is the arrangement of the conditions of contract for all contracts by the offerer of Mutekki Media Ltd. (MUTEKKI), which will be concluded at the online shop. Valid are always the general terms of business at the time during the conclusion of a contract becoming effective version. Any terms of business of the customer will lodge a protest by MUTEKKI precautionaly.

§ 2 Be signed of the contract
The offers at the online shop are non-committal. By clicking the order-button and/or sending per E-Mail, the user declares to the offerer binding, to will purchase the content of the shopping bag. The contract is not be signed by a statement of MUTEKKI after sending the order, but with forwarding the articles. The statement will be send to the user directly after clicking the order-button.

§ 3 Disclosures of duties
1. At registration, the user is obliged to give personal data truthfully. If datas have changed, specially name, address, E-Mail address, phone number ..., the user is obliged to inform the offerer immediately.
2. If the user fails this information or gives wrong datas from the beginning, especially wrong E-Mail address, the offerer is allowed to resign the contract as far as a contract has been signed. The cancellation of contract will be declared in a written form. The written form is granted after sending E-Mail too.
3. After concluding the contract, MUTEKKI sends the customer one E-Mail with the customer information immediately to the E-Mail address which the user has given during registration.
4. The user is obliged to inform the offerer under shop@mutekki-media.de without delay, if this E-Mail has not reached the user within 24 hours after conclusion the contract.
5. The user has to take care that his E-Mail account is available and not unavailable because of passing on, shut-down or abundance.
6. Wrong information will be supposed if an E-Mail to the user returns or the service can not render because of a wrong address.

§ 4 Password, secrecy, loss
1. While registrating, the user has to give necessary datas for carrying out the order. He receives one customer number and one password.
2. If the customer number and password are placed, there is no need for the following sales to state more information for the dispatch. The goods will be delivered to the address which the user gave to us during registration.
3. At the same time the customer number and the password allow the user to have a look at his datas and if necessary to change these. Also the user can have a look at his orders made with the user customer number (ID) and password.
4. The user is obliged to keep the customer number and password carefully and treat them in a way, that a loss is impossible and third can not take note of it.
5. When loosing the password the user is obliged to inform MUTEKKI immediately.

§ 5 Offer / availability
1. All offers and costs estimates are without obligation by MUTEKKI until conclusion of contract has been made.
2. Dispatch is only possible as long as stock losts.

§ 6 Cancellation right
1. The customer has the right to rescind the contract corresponding to the legal provision.
2. In the event of a cancellation the customer has to bear the costs of return consignment unless the delivered goods do not agree with the ordered goods. The customer is obliged to return the goods within 2 weeks after the execution of cancellation right if the cancellation has not exercised by return consignment already.

§ 7 Delivery of the goods
1. On receipt, the order will be processed by the offerer without delay. The delivery usually will be made within 3-5 days. On the basis of shortages a longer delivery time can be possible.
2. At delivery of the goods by forwarding agency ( e.g. DHL) MUTEKKI has to perform his service and is at the consignees risk.
3. Does MUTEKKI not perform his promised service at the time agreed upon, the user can resign the contract.
4. MUTEKKI reserves the right, in case of non-availability of the performance as contracted, to render a performance (goods or service) equivalent in quality and price. If the substitute has just been delivered and the customer refuses the substitute the customer will return it at MUTEKKIs expense.
5. Part delivery is allowed.

§ 8 Prices and payment
1. Quoted prices at the online shop MUTEKKI are total prices and include at the invoice date valid the value-added tax.
2. The purchase price is due at sight unless otherwise agreed.
3. The user automatically defaults when payment will not be made after 30 days on receipt the invoice.
4. In the event of default the legal interest for arrears will be charged.
5. The right of set-off is only entitled to the customer if counterclaim effective established or the counterclaims were admitted by the offerer.
6. The customer can only exercise his right of retention, if his counterclaim is based on the same contractual relation.

§ 9 Exclusive right
Until total payment, the goods delivered belong to ownership of the offerer regardless whether expiration period. As far as MUTEKKI exchanges goods in the course of the guarantee, today it will just agreed, that the ownership at the exchangeable good pass into MUTEKKIs possession from the customer at this time mutual and the other way round, as the customer returns the goods to MUTEKKI on the one hand or rather the customer receives the substitutes by MUTEKKI.

§ 10 Guarantee
The guarantee follows the legal provision in accordance with the following controlings:
1. The user is obliged to inspect the delivered goods immediately if there is any error. Should he locate an obvious error he must inform the offerer within one week, in the same way with hidden-shortages. Otherwise the guarantee for this shortages is canceled.
2. Mutekki is not liable for errors caused by the user. That applies to normaly signs of wear too. The execution of the cancellation right of the user is still untouched by it.
3. Natural wear and tear is out of guarantee.
4. When complaining the date of sale must be proved with one invoice. The complained article must be sent in with a copy of invoice ( enough postage paid ).
5. The guarantee expires when the customer changes the goods delivered.
6. During the obligation of guarantee MUTEKKI has the right to touch up the goods for free. A partly or completely substitution of the article is alowable. Should faulties not be repaired within an adequate deadline, the customer is entitled to conversion or deduction. § 476a BGB in force.

§ 11 Application right
German right is in force under the execution of the companies-sales law.
